Ancestral Forest Terms & Conditions

General

Ancestral Forest is an Internet service owned and operated by Digitalica Limited, a company registered in England (registration no. 6311539). The terms "we" or "us" refer to Digitalica Limited. The terms "this service" or "the service" refer to the Ancestral Forest service.

The terms "You" or "your" refer to a registered user of the Ancestral Forest service. You should be at least 16 years of age to use this service. If you allow anyone under the age of 16 to access this service, you take full responsibility for any action they take during use of the service. Your registration for and use of this service indicates your acceptance of these terms and conditions and our Privacy Policy. If you do not wish to be legally bound by these terms and conditions you must not use the Ancestral Forest service.

We reserve the right to change these terms and conditions at our discretion by advising of such amendments on the Ancestral Forest homepage and posting the amended terms and conditions on the Ancestral Forest website.

Your continued use of the Ancestral Forest service after changes are posted indicates your acceptance of those changes. If you do not wish to be legally bound by any future amended terms and conditions then you must discontinue use of the service.

The Ancestral Forest service provides a website that may be accessed by members to upload and maintain genealogical information. The service may also be accessed by guests invited to do so by the member responsible for the information.

Members can only grant guests access to the material for which they are responsible. Whether you are a member or invited guest of the Ancestral Forest service, you acknowledge that Ancestral Forest is merely hosting the material on your behalf and accepts no liability whatsoever for the content or accuracy of the material provided by members.

Membership

Users can register as one of 2 types of member:

  • Full member
  • Guest

Full Members

Full members are users that have paid a subscription fee to join Ancestral Forest. As a full member, you are entitled to use the following facilities:

  • Create and amend your family tree (up to 3 separate trees)
  • Upload photographs of individuals or groups of individuals contained in your family tree.
  • Contact other full members using the Ancestral Forest Messaging Service.
  • Use the Ancestral Forest Search facility to check for the presence of named individuals not within your own family tree(s). This facility is limited to the search for non-living individuals and provides a limited amount of information (name, year and place of birth) but provides the facility to contact the Full Member responsible for the details held on that individual.
  • Receive e-mail newsletters (you may opt in/out of this during registration or by accessing your "My Preferences" page once you have joined)

If you register as a full member, you are agreeing to become a subscribing member for the subscription period.

When you first register (and pay your initial subscription), you have the right to cancel your membership during the first 7 days of membership. This is in accordance with the Consumer Protection (Distance Selling) Regulations 2000.

Full membership is on an annual basis. Your subscription will NOT be renewed automatically. You will however be reminded 2 weeks before your subscription is due to expire and asked if you wish to renew your membership. The reminder will be in the form of an e-mail and a message displayed within your member homepage. Both the reminder e-mail and your homepage will provide a link to allow you to renew your membership by paying a further subscription.

Guests

Guests are users that have registered with Ancestral Forest but have not paid a subscription fee. As a guest, you are entitled to use the following facilities:

  • Access (but not update) any family tree to which you have been invited by the full member that owns the tree.
  • Use the Ancestral Forest Search facility to check for the presence of named individuals not within your own family tree(s). This facility is limited to the search for non-living individuals and provides a count of the number of individuals that satisfy your search criteria.
  • e-mail
  • Receive newsletters (you may opt in/out of this during registration or by accessing your "My Preferences" page once you have joined)

Guest membership is on a continuous basis. Your membership will continue until you choose to cancel your membership.

Non-Member Access

Non-members can access the Ancestral Forest website, but are not permitted to view information contained within members' family trees. The one exception to this is the "Search" facility which non-members can use to check for the presence of named individuals held on the Ancestral Forest database. This facility is limited to the search for non-living individuals and provides a count of the number of individuals that satisfy your search criteria.

Members Responsibilities

You are responsible for the proper management and confidentiality of the material you hold on the Ancestral Forest service. As such, you are responsible for the control of access to your family tree(s). This includes confidentiality of your own password and of authorisation codes you give to guests for the purpose of viewing family trees.

Members must have the permission of any living person to include their details in a family tree. If an individual does not consent, their details must be removed.

If any photograph intended for use in your family tree contains images of living individuals, you must obtain those individuals consent to its use before uploading it to Ancestral Forest.

Ancestral Forest reserves the right to remove any images or details of a living individual if requested by the individual concerned.

Members agree not to defame, abuse, harass, threaten or breach the confidence of other members or of individuals represented in their family tree(s).

Members agree not to upload or insert any defamatory, abusive, offensive, obscene or unlawful material or information either in text or image form.

Members agree not to impersonate any other individual.

Service Provision

Provision of the Ancestral Forest service is intended to be as near as possible 24 hours a day, 365 days a year. There may be occasions when the service is temporarily unavailable for maintenance purposes, but these will be kept to a minimum.

Ancestral Forest takes no responsibility, nor will be held liable for any aspect of the service being made temporarily unavailable due to technical issues beyond our control.

Membership Cancellation

You may cancel your Ancestral Forest membership at any time.

If you wish to terminate your subscription, you must notify Ancestral Forest at least 4 days before the renewal date by sending a message via the "Contact" web-page.

If you cancel your membership more than 7 days after your initial registration, your subscription fee will not be refunded for any unused portion of the subscription period.

Your access to the members area (and therefore your family trees) will be stopped as soon as your membership cancellation has been recorded.

As a full member, any data you have loaded to Ancestral Forest remains your intellectual property and as such you are entitled to a copy of the contents of your family tree. We will provide this to you in the form of a GEDCOM file which we will send to your registered e-mail address within 7 days of you cancelling your membership. This applies only to textual information. Images uploaded to Ancestral Forest will not be returned as these are copies of images that you already possess.

Membership Termination

We reserve the right to suspend or terminate any member's access to the Ancestral Forest service if they are deemed to be in breach of any of these terms and conditions.

Complaints

Complaints should be communicated to us through our "Contact" web-page on the Ancestral Forest website. We will reply to all complaints within 5 working days.
